Hatters of America, LLC (“Hatters of America”) respects the privacy of others. 1. A Special Note About Minors.

The Site is a general audience website intended for use by adults. The Site is not designed or intended to attract, and is not directed to, children under eighteen (18) years of age, let alone children under thirteen (13) years of age. Hatters of America does not collect personal information through the Site from any person it actually knows to be under thirteen (13) years of age. Hatters of America is not responsible for failing to comply with any Request for Removal of Minor Information that is incomplete, incorrectly labeled or incorrectly sent.

Also, please note that Hatters of America is not required to erase or otherwise eliminate, or to enable erasure or elimination of, such content or information in certain circumstances, such as, for example, when an international, federal, state, or local law, rule or regulation requires Hatters of America to maintain the content or information; when the content or information is stored on or posted to the Site by a third party other than you (including any content or information posted by you that was stored, republished or reposted by the third party); when Hatters of America anonymizes the content or information, so that you cannot be individually identified; when you do not follow the aforementioned instructions for requesting the removal of the content or information; and when you have received compensation or other consideration for providing the content or information.

• l. Third-party website, network, platform, server and/or application information. Examples include, but are not limited to, Facebook, Twitter, and Instagram;

3. How Information Is Collected.

• f. Scripts, which are pieces of code embedded in a website to define how the website behaves in response to certain key or click requests sent by the user. 5. Sharing of Information Collected.

Any third parties who Hatters of America believes are necessary to help or allow Hatters of America to protect and enforce its rights and properties, including, without limitation, to enforce its rights under Hatters of America’s Terms and Conditions or any other agreements Hatters of America has with you, and to protect and enforce its intellectual property rights; and/or
• h. Any third parties who Hatters of America believes are necessary to help or allow Hatters of America to protect the rights and properties of other (which may include you), assuming that Hatters of America believes it has an obligation to do so.

Hatters of America also reserves the right to share your personal information with third parties in connection with or as a result of any potential or actual merger, acquisition or other event involving a change in ownership or control of Hatters of America or Hatters of America’s business (whether by sale of assets, merger, stock purchase or otherwise).

Hatters of America does not limit the ways in which it might use or share non-personal information – and Hatters of America reserves the unencumbered right, but not the obligation, to use or share non-personal information – because non-personal information does not identify you. For example, Hatters of America may freely share non-personal information with its parent, subsidiary and affiliated companies, its vendors, its suppliers, its representatives and other individuals, businesses and government entities.

You may choose to share certain information and/or follow other users on the Site. You may choose to share your contact information with other users or provide it publicly.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Data Retention.

Hatters of America may retain your personal information and non-personal information for as long as it is reasonably necessary for a legitimate business purpose. Hatters of America may dispose of or delete any such personal information or non-personal information at any time, except as set forth in any other agreement or document executed by both you and Hatters of America concerning the same or as required by law.

7. Transactions.

In connection with any transaction that you conduct on, through or in relation to the Site, you may be asked to supply certain information relevant to the transaction, including, without limitation, your credit card number and expiration date, your billing address, your shipping address, your phone number and/or your email address. By submitting such information, you consent to providing such information to third parties (e.g., payment processing companies, online shopping cart providers) for the purpose of facilitating the transaction.

All credit card, debit card and other monetary transactions on or through the Site occur through an online payment processing application. This online payment processing application is provided by Shopify, which is a third-party online payment processing vendor.

If you choose a direct payment gateway to complete your purchase, then Shopify, Paypal or other stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

8. Third Parties and Their Applications and Networks.

The Site and/or any communications sent through or as a function of the Site might contain links to third-party websites, networks, platforms, servers and/or applications. Third-party websites, networks, platforms, servers and/or applications might also contain links to the Site.

9. Security.

Hatters of America implements security measures to help protect the personal information it collects through the Site. For example, Hatters of America encrypts the transmission of information through the Site by using secure socket layer (SSL) technology.

To help maintain the security of your personal information, Hatters of America asks that you please notify it immediately of any unauthorized visit, access or use of the Site, or the loss or unauthorized use of your user access information for the Site (e.g., username or password).

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

12. Users outside the United States.

We are headquartered in the United States of America. Personal information may thus be accessed by us or transferred to us in the United States. By providing us with personal information, you consent to the storage or processing of your personal information in the United States and acknowledge that the personal information will be subject to the laws of the United States, including the ability of governments, courts or law enforcement or regulatory agencies of the United States to obtain disclosure of your personal information.

We will protect the privacy and security of personal information according to this Privacy Policy, regardless of where it is processed or stored.

13. Online Tracking

Hatters of America does not respond to “do not track” (DNT) signals.

We regularly review and revise our Privacy Policy. We make changes to the Privacy Policy available on this page and note that the policy has been updated. If we make material changes to how we treat your personal information, we will notify you by email to the primary email address specified in your account and through a notice on our home page.

Hatters of America may decide to sell, buy, merge or otherwise reorganize its business.
